1. Introduction

Painting with Light BV (having its registered office at 3600 Genk, C-Mine 127 and registered with the Crossroads Bank for Enterprises under the number 0465.286. 234) (hereinafter referred to as "Painting with Light", "PWL", "We", "us" or derivatives), as Processing Controller, shall only collect, store, retain, consult, process and transfer (hereinafter referred to as: "Processing") in accordance with applicable Belgian and European privacy laws including, but not limited to, the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), (hereinafter referred to as: "GDPR") and the Belgian law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data.

By means of this Privacy and Data Protection Policy (hereinafter referred to as "Policy" or "Privacy Statement"), we describe the way in which we process data pertaining to you or on the basis of which we can directly or indirectly identify you (hereinafter referred to as "Personal Data") in connection with the use of the website www.pwl.be (hereinafter referred to as "Website") and/or in the context of the agreements concluded with Painting with Light and delivery of our products and/or services, when you apply (online) for one of our vacancies, etc. In particular, we explain how and why we collect your Personal Data, as well as on what legal grounds and how we use it to improve your user experience, what we do with it, with whom we share it, how we protect it, how long we keep it and inform you about your rights.

Your acceptance of the provisions of this Policy means that you consent to the manner in which we process your Personal Data as set forth in this Policy.

This Privacy Statement relates only to Personal Data processed by us. We do not accept, to the extent permitted by law, any responsibility or liability for (the operation and/or content of) third-party services and/or websites.

We collect your Personal Data when:

  • you purchase our goods and/or services (such as we can communicate with you and provide our services efficiently),

  • when you use our Website;

  • when you apply for one of our vacancies through our Website;

  • In the event of complaints, additional questions or comments, etc.;

  • you fill in the contact form on our Website;

  • you request a quote on our Website or by e-mail;

Personal data you provide to us:

  • Identification and contact data: first name, last name, gender, e-mail address, phone number

  • Professional data: company name, VAT no., professional address, phone number

  • Location: your postal address/or other place where the goods will be delivered and/or the services will be performed or the Website will be used;

  • Payment data: bank account number, billing information;

  • Data in the context of job applications: name of current employer, position (title), content CV.

  • Cookies and similar technologies;

  • Log files when using our Services;

  • Metadata;

  • Analytical data;

  • Other Personal Data you provide with your question, comment, complaint, order, etc.

B. Purposes and legal bases:

  • Where the Processing is necessary for the performance of a contract to which you are a party or to take measures at your request to provide the goods/services:

    • To enable the use of the Website;

    • To conclude a contract with us;

    • To provide information and advice;

    • To manage our business and day-to-day operations under the agreement;

    • To perform ongoing agreements (including but not limited to tracking orders and delivering goods/services);

    • For any other interactions you have with us, e.g. administrative or technical purposes, to ensure the functionality of our Services, etc.

  • When Processing is necessary to pursue our legitimate interest except when our interests must give way to your fundamental rights and freedoms:

    • To follow up on our offers and/or send reminders;

    • To provide you, as an existing customer, with information regarding our similar promotions and goods/services if your Personal Data was obtained directly from the sale of our Services (you hereby have the right to oppose, free of charge, the advertising received);

    • For possible other interactions we may have with you. For example, when you contact us for questions, comments, complaints or other requests to respond to your inquiry;

    • To secure, customize and improve our Website;

    • To maintain the accuracy and relevance of your Personal Data;

    • In the context of an (online) job application (through our Website);

    • Etc.

  • When the Processing of your Personal Data is necessary to comply with a legal obligation:

    • Tax obligations.

    • Providing information to a governmental or law enforcement agency;

    • In the context of anti-money laundering obligations;

    • Etc.

C. Retention period

We retain your Personal Data only for as long as necessary and ensure its appropriate protection. How long we keep your Personal Data depends on the purpose for which we use it, as described in this Policy.

After termination of the agreements, we have entered into with you, we will delete or anonymize your Personal Data no later than after five (5) years, unless we are required by law to keep your Personal Data longer.

If you do not provide your Personal Data, the possible consequence is that we may not be able to offer our products/services or provide them (optimally). We will notify you if this would be the case.

5. How do we protect your Personal Data?

We have taken a number of technical and organizational security measures to protect your Personal Data from unauthorized or unauthorized access or use and from accidental loss or damage to its integrity. These measures have been taken considering our IT infrastructure, the potential impact on your privacy, the associated costs and in accordance with current industry standards and practices.

We ensure that your Personal Data is kept in a sufficiently protected environment and that only the necessary persons have access to your Personal Data. For example, your Personal Data will be stored on our own secure servers or those of a third party, in each case within the European Economic Area.

Your Personal Data will only be processed by a third party if that third party agrees to comply with technical and organizational data security measures.

6. With whom do we share your Personal Data?

Depending on the purpose for which we collect your Personal Data, we may share your Personal Data with another affiliate or subsidiary of Painting with Light.

Furthermore, for the provision of our products/services, we may share your Personal Data with third parties who are trusted partners in ensuring our operability and continuity of our services, such as (among others) those responsible for transportation/delivery of the services, accountant(s), lawyers, etc.

These partners have confirmed to us to respect the GDPR (and all other applicable Belgian and European privacy laws) and not to use the data for purposes other than the aforementioned.

Finally, we may disclose your Personal Data to third parties if we are required to do so by law and/or regulation, if we are compelled to do so as a result of legal proceedings and/or in the event we deem it necessary to protect our won rights.

7. Transfer of Personal Data outside the EEA?

In addition, it is also possible that your Personal Data may be transferred to a partner of Painting with Light outside the European Economic Area (hereinafter referred to as "EEA"). Any transfer to a recipient domiciled or based in a country without an adequacy decision (link) taken by the European Commission will be governed by an agreement that meets the required appropriate safeguards for the transfer of Personal Data outside the EEA, such as, for example, the standard contractual clauses approved by the European Commission (link).

8. Use of cookies

We make use of so-called "cookies" on our Website. Cookies can be regarded as pieces of data sent by the Web server to your browser, which writes this data onto your computer's hard drive. The use of cookies enables us to provide you with faster and more efficient access to our Website. You can disable the use of cookies in your browser settings. If you register with Painting with Light or on the Website through a third party (social media) account, such as (but not limited to) Facebook, Instagram, LinkedIn, Google, etc., you accept that the terms of use and privacy policy of the third party in question will apply. We are not liable for the processing of your Personal Data by these third parties.

10. What are your rights?

Please note that you have the following rights regarding our Processing of your Personal Data:

  • Right of access and correction: you have access to your Personal Data. If the Personal Data we hold about you is inaccurate, you may ask us to correct any inaccuracies;

  • Right to restriction of Processing: you have the right to request a restriction of Processing when we do not (or no longer) have the right to use your Personal Data or when you dispute its accuracy;

  • Right to object to Processing: if applicable, you have the right to object to the Processing of your Personal Data by us if we no longer have the right to use it, to the Processing by us of your Personal Data for certain purposes, to demand that we delete your Personal Data if we keep it for too long, or to demand that, in certain circumstances, the Processing be subject to restrictions. In particular, you may object, free of charge and without justification, to Processing for purposes of direct marketing (e.g. emails);

  • Right to erasure: you have the right to erasure of all your Personal Data (except in some cases, for example, to prove a transaction or when required by law);

  • Right to data portability: under certain conditions, you have the right to receive your Personal Data you have provided to us in a common, structured, machine-readable format and to transfer your Personal Data to a third party of your choice.

  • Right to withdraw your consent: where your Personal Data is processed on the basis of your consent, you may withdraw this consent at any time, without justification;

  • Right to Information: where we intend to further process Personal Data for a purpose other than that for which the Personal Data was collected pursuant to this Privacy Statement, we will provide you with further information about that other purpose and any other relevant information prior to such further processing.

The above rights may only be exercised in a reasonable manner and in accordance with applicable law.

You may make a request or exercise these rights by contacting us (see Art. 2 of this Privacy Statement for our contact details), whereupon we will make all reasonable and practicable efforts to comply with your request to the extent that it does not conflict with applicable law and professional standards. However, you should be aware that the Personal Data (and the Processing) are necessary for the provision of the goods/performance of the services and/or for our legitimate interest. This means that any modification to your original consent may result in the termination of our services.

We strive to answer your request within one (1) month. In case of complex or frequent requests, this deadline may be extended by another two (2) months. In any case, we will notify you within one (1) month in case of any extension.

In principle, you may exercise these rights free of charge, except in cases of excessive requests, manifestly unfounded requests or frequently repeated requests where we may charge a reasonable administrative fee.

12. Changes to our Policy.

From time to time, we may supplement, amend, update or modify this Policy. These changes will be announced on our Website and will include the latter modification date.

If we change the Policy in a way that affects how your Personal Data will be used or the rights you grant to Painting with Light, we will notify you and ask you to review the new Policy.

We encourage you to review this Policy regularly to stay informed about how we process and protect your Personal Data.
